This Privacy Policy explains how we collect, use, disclose, store, and safeguard your information when you visit our website at patriothauls.com, use our mobile applications, or access any of our services, features, or functionalities (collectively, the “Platform”).

    By accessing or using the Platform, you acknowledge that you have read, understood, and agree to the collection, use, and disclosure of your information as described in this Privacy Policy. If you do not agree with the terms of this Privacy Policy, please do not access or use the Platform.

    This Privacy Policy is incorporated into and subject to our Terms of Service, available at patriothauls.com/terms. Capitalized terms not defined herein have the meanings assigned to them in our Terms of Service.

    2. Scope of This Privacy Policy

    This Privacy Policy applies to all information collected through the Platform, including our website (patriothauls.com), any associated mobile applications, email communications, text messages (SMS/MMS), telephone calls, and any other services we offer in connection with the Platform. This Privacy Policy does not apply to the practices of companies or individuals that Patriot Hauls does not own or control, including Operators listed on the Platform or other third-party websites, services, or applications that may be linked from the Platform.

    3. Information We Collect

    3.1 Information You Provide Directly

    We collect information that you voluntarily provide to us when you:

    • Create an account (name, email address, phone number, password)
    • Register as an Operator (business name, business address, phone number, email, EIN/tax identification number, business description, equipment details, pricing, service areas, hours of operation)
    • Submit a rental inquiry or contact request (name, email, phone number, rental details, dates, location)
    • Subscribe to a paid plan (billing name, billing address, payment card information via our payment processor Stripe)
    • Submit reviews, ratings, photos, or other User Content
    • Contact us for customer support or inquiries
    • Respond to surveys, promotions, or marketing communications
    • Sign up for our newsletter or marketing emails
    • Participate in contests, sweepstakes, or promotions
    • Apply for our Founding Member or partner programs

    3.2 Sensitive Operator Documents

    If you are an Operator, we may collect the following sensitive documents as part of our verification process:

    • DD-214 (Certificate of Release or Discharge from Active Duty): Collected solely for the purpose of verifying veteran status for the Veteran-Owned badge. DD-214 documents are stored securely with encryption, accessed only by authorized personnel for verification purposes, and are never shared publicly, with other Users, or with any third party except as required by law.
    • Insurance Certificates (Certificate of Insurance / COI): Collected to verify that Operators maintain adequate commercial general liability insurance. Insurance certificates are stored securely and used solely for badge verification and compliance monitoring. Insurance status indicators (e.g., “Insured” badge) may be displayed publicly on Operator listings; however, the actual insurance documents are never shared publicly or with other Users.
    • Business Licenses and Permits: Collected as part of operator verification to confirm that Operators are duly licensed to operate in their jurisdictions.

    3.3 Information Collected Automatically

    When you access or use the Platform, we automatically collect certain information, including:

    • Device and Browser Information: IP address, browser type and version, operating system, device type, device identifiers, screen resolution, and language preferences.
    • Usage Information: Pages viewed, links clicked, time spent on pages, search queries, referring and exit URLs, date and time of visits, and other browsing activity on the Platform.
    • Location Information: Approximate geographic location based on your IP address. We do not collect precise GPS location data without your explicit consent.
    • Cookies and Tracking Technologies: Information collected through cookies, pixel tags, web beacons, and similar technologies. See Section 8 (Cookies and Tracking Technologies) for more information.

    3.4 Information from Third Parties

    We may receive information about you from third-party sources, including:

    • Payment processors (Stripe) for transaction verification and fraud prevention
    • Analytics providers (such as Google Analytics) for Platform usage analysis

    4. How We Use Your Information

    We use the information we collect for the following purposes:

    4.1 Providing and Improving the Platform

    • Operating, maintaining, and improving the Platform and our Services
    • Connecting Renters with Operators and facilitating rental inquiries
    • Processing account registrations and managing User accounts
    • Processing payments and subscriptions
    • Verifying Operator credentials, licensing, insurance, and veteran status
    • Administering badge and verification programs
    • Providing customer support and responding to inquiries
    • Personalizing your experience on the Platform

    4.2 Communications

    • Sending transactional emails and notifications (account confirmations, inquiry updates, subscription receipts)
    • Sending text messages (SMS/MMS) with your prior express consent, as described in Section 5
    • Sending marketing and promotional communications (with your consent and subject to your opt-out preferences)
    • Providing Platform updates, service announcements, and administrative notices

    4.3 Safety, Security, and Legal Compliance

    • Detecting, investigating, and preventing fraudulent, unauthorized, or illegal activity
    • Protecting the safety, rights, and property of Patriot Hauls, our Users, and the public
    • Enforcing our Terms of Service and other agreements
    • Complying with applicable laws, regulations, legal processes, or governmental requests
    • Responding to lawful requests from law enforcement or government authorities

    4.4 Analytics and Research

    • Analyzing Platform usage, trends, and demographics to improve our Services
    • Conducting internal research and development
    • Generating aggregate, de-identified, or anonymized data for business analysis

    5. SMS/Text Message Data and Privacy

    This section specifically addresses how we collect, use, and protect information related to our text messaging (SMS/MMS) communications. This section is provided in compliance with the Telephone Consumer Protection Act (TCPA), the Cellular Telecommunications Industry Association (CTIA) Messaging Principles and Best Practices, and applicable state laws governing text messaging.

    5.1 What SMS Data We Collect

    When you opt in to receive text messages from Patriot Hauls, we collect and store:

    • Your mobile phone number
    • The date, time, and method by which you provided consent to receive text messages
    • Records of text messages sent to and received from your number (including message content, timestamps, and delivery status)
    • Your opt-out requests and the date and time of any opt-out

    5.2 How We Use SMS Data

    We use your SMS data to:

    • Send you the text messages you have consented to receive (account notifications, inquiry updates, promotional messages, etc.)
    • Process your opt-out requests and ensure compliance with your preferences
    • Monitor message delivery and troubleshoot technical issues
    • Maintain records of consent as required by applicable law
    • Comply with legal and regulatory requirements

    5.3 SMS Data Sharing

    We do not sell, rent, or share your SMS opt-in data, consent records, or phone number with any third party for their own marketing or promotional purposes. We may share SMS-related data only with:

    • Our SMS Service Provider (Twilio): We use Twilio as our text messaging service provider. Twilio processes and transmits text messages on our behalf and may have access to your phone number and message content solely for the purpose of delivering our messages. Twilio’s use of your information is governed by Twilio’s privacy policy.
    • Law Enforcement: We may disclose SMS data if required by law, subpoena, court order, or other legal process, or if we believe in good faith that disclosure is necessary to protect our rights, your safety, or the safety of others.

    5.4 SMS Data Retention

    We retain SMS consent records for at least ten (10) years from the date of your last interaction, in compliance with applicable state laws including Virginia SB 1339. We retain text message logs for a minimum of three (3) years for compliance and dispute resolution purposes. Opt-out records are maintained indefinitely to ensure we honor your opt-out preferences.

    5.5 Your SMS Rights

    You have the right to:

    • Opt out of text messages at any time by replying STOP to any message
    • Request information about the text messages we have sent to your number
    • Request deletion of your SMS data (subject to our legal retention obligations)
    • Contact us at support@patriothauls.com or reply HELP to any message for assistance

    6. How We Share Your Information

    We do not sell your personal information. We may share your information in the following circumstances:

    6.1 With Operators (for Renters)

    When you submit a rental inquiry, contact request, or review through the Platform, we share the information you provide (such as your name, email, phone number, and inquiry details) with the relevant Operator so they can respond to your request. Once your information is shared with an Operator, it is subject to that Operator’s own privacy practices.

    6.2 With Renters (for Operators)

    Operator business information, including business name, location, contact details, equipment listings, pricing, reviews, ratings, and badge status, is publicly displayed on the Platform and may be indexed by search engines.

    6.3 With Service Providers

    We share information with third-party service providers who perform services on our behalf, including:

    • Payment processing (Stripe)
    • Text messaging and communications (Twilio)
    • Email services and marketing automation
    • Cloud hosting and data storage
    • Analytics and performance monitoring (Google Analytics)
    • Customer support tools
    • Fraud detection and prevention services

    These service providers are contractually obligated to use your information only to provide services to us and in accordance with this Privacy Policy.

    6.4 For Legal Purposes

    We may disclose your information if we believe in good faith that disclosure is necessary to: (a) comply with applicable law, regulation, legal process, or governmental request; (b) enforce our Terms of Service or other agreements; (c) protect the rights, property, or safety of Patriot Hauls, our Users, or the public; (d) detect, prevent, or address fraud, security, or technical issues; or (e) respond to an emergency involving danger of death or serious physical injury.

    6.5 Business Transfers

    In the event of a merger, acquisition, reorganization, sale of assets, or bankruptcy, your information may be transferred to the acquiring entity or successor. We will provide notice before your information is transferred and becomes subject to a different privacy policy.

    6.6 Aggregate and De-Identified Data

    We may share aggregate, de-identified, or anonymized data that cannot reasonably be used to identify you with third parties for business analysis, research, marketing, or other purposes.

    7. Data Security

    We implement and maintain reasonable administrative, technical, and physical security measures designed to protect your personal information from unauthorized access, disclosure, alteration, destruction, or loss. These measures include:

    • Secure storage of sensitive documents (DD-214, insurance certificates) with access controls and encryption

    No method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially reasonable means to protect your personal information, we cannot guarantee its absolute security. You are responsible for maintaining the security of your account credentials and for any activity that occurs under your account.

    8. Cookies and Tracking Technologies

    8.1 Types of Cookies We Use

    • Essential Cookies: Necessary for the Platform to function properly, including session management, authentication, and security. These cookies cannot be disabled.
    • Analytics Cookies: Help us understand how Users interact with the Platform, including which pages are visited most frequently, traffic sources, and user engagement metrics. We use Google Analytics and similar tools for this purpose.
    • Functional Cookies: Enable enhanced functionality and personalization, such as remembering your preferences, language settings, and search history.
    • Advertising/Marketing Cookies: Used to deliver relevant advertisements and measure the effectiveness of our marketing campaigns. These cookies may track your browsing activity across other websites.

    8.2 Managing Cookies

    You can control cookies through your browser settings. Most browsers allow you to refuse or delete cookies, block third-party cookies, or set preferences for specific websites.     8.3 Do Not Track

    Some browsers offer a “Do Not Track” (“DNT”) feature. There is currently no uniform standard for how companies should respond to DNT signals. At this time, the Platform does not respond to DNT signals. However, you can manage your tracking preferences through your browser settings and the cookie controls described above.

    9. Data Retention

    We retain your personal information for as long as necessary to fulfill the purposes for which it was collected, including to satisfy any legal, accounting, or reporting requirements. Specific retention periods include:

    • Account Information: Retained for the duration of your active account and for up to three (3) years after account closure, unless a longer retention period is required by law.
    • Transaction and Payment Records: Retained for at least seven (7) years for tax and accounting compliance.
    • SMS Consent Records: Retained for at least ten (10) years from the date of your last interaction.
    • Text Message Logs: Retained for at least three (3) years.
    • Operator Verification Documents (DD-214, COI): Retained for the duration of the Operator’s active listing and for one (1) year after removal, unless required longer by law.
    • User Content (Reviews, Photos): Retained indefinitely unless you request deletion or we remove the Content pursuant to our Terms of Service.

    10. Your Privacy Rights

    10.1 All Users

    Regardless of where you are located, you have the right to:

    • Access the personal information we hold about you
    • Request correction of inaccurate or incomplete personal information
    • Request deletion of your personal information (subject to certain exceptions)
    • Opt out of marketing communications at any time
    • Opt out of text messages by replying STOP
    • Withdraw your consent to the processing of your personal information (where consent is the legal basis for processing)

    10.2 Texas Residents

    If you are a Texas resident, the Texas Data Privacy and Security Act (TDPSA) provides you with specific rights regarding your personal data. In addition to the rights listed above, you have the right to:

    • Confirm whether we are processing your personal data
    • Access your personal data
    • Correct inaccuracies in your personal data
    • Delete your personal data
    • Obtain a copy of your personal data in a portable and readily usable format
    • Opt out of the processing of your personal data for purposes of targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects

If we are unable to comply with your request, we will provide you with an explanation.     10.3 California Residents (CCPA/CPRA)

    If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), including:

    • The right to know what personal information we collect, use, disclose, and sell
    • The right to delete your personal information
    • The right to opt out of the sale or sharing of your personal information
    • The right to non-discrimination for exercising your privacy rights
    • The right to correct inaccurate personal information
    • The right to limit the use and disclosure of sensitive personal information

    We do not sell your personal information as defined under the CCPA/CPRA. We do not use or disclose sensitive personal information for purposes other than those permitted by the CCPA/CPRA.

    10.4 Other State Privacy Laws

    If you are a resident of Virginia, Colorado, Connecticut, Utah, Oregon, Montana, or any other state with applicable consumer privacy legislation, you may have additional rights under your state’s privacy law. Please contact us at privacy@patriothauls.com to exercise your rights, and we will respond in accordance with applicable law.

    11. Children’s Privacy

    The Platform is not directed to, and we do not knowingly collect personal information from, children under the age of thirteen (13). If you are under 13, you are prohibited from using the Platform. If you are between the ages of 13 and 18, you may only use the Platform with the consent of a parent or legal guardian. If we become aware that we have inadvertently collected personal information from a child under 13, we will take steps to delete such information promptly.     12. Third-Party Links and Services

    The Platform may contain links to third-party websites, services, or applications that are not owned or controlled by Patriot Hauls. This Privacy Policy does not apply to any third-party websites or services. We are not responsible for the privacy practices or the content of any third-party websites or services. We encourage you to review the privacy policies of any third-party websites or services before providing them with your personal information. Any information you provide to third-party websites or services is governed by their respective privacy policies.

    13. International Data Transfers

    The Platform is operated from and our data is stored in the United States. If you access the Platform from outside the United States, you understand and consent to the transfer of your personal information to the United States, where data protection laws may differ from those of your jurisdiction. By using the Platform, you consent to the transfer, processing, and storage of your information in the United States.

    We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or for other operational reasons.
